Welcome to map-icec.com (the “Website”), operated by MARKER AND PIONEER CORP. (“MAP,” “we,” “us,” or “our”), a Florida nonprofit corporation supporting international cultural exchange, music education, and artistic activities.

These Terms & Conditions (“Terms”) govern your use of the Website and, where incorporated into a registration or transaction, your participation in programs and services offered by MAP. Please read them before submitting an application, making a payment, or participating in a program. When asked to accept these Terms, you should proceed only if you agree to them.

1 Website and Program Information

The Website provides information about MAP and its competitions, educational activities, performances, cultural exchange initiatives, and related opportunities. Some activities may be delivered through separate websites or third-party platforms.

Individual programs, including the MAP International Music Competition (“MAP-IMC”), may have additional regulations, eligibility requirements, fees, deadlines, consent forms, and participation agreements. Those provisions apply when disclosed and accepted as part of the relevant registration. If they conflict with these Terms, the specific program provisions control for that program, subject to applicable law. Visiting a linked website does not by itself make these Terms apply to that website.

2 Eligibility and Authorized Representatives

You must provide accurate and complete information and meet the requirements of the program for which you apply. Please notify us promptly of errors or material changes to your application or contact details.

An adult with legal capacity must complete registrations and payments. Participants under 18, or under the age of legal majority where they live, must have the involvement and consent of a parent or legal guardian. Children under 13 should not independently submit personal information through the Website; a parent or legal guardian should contact us to arrange an appropriate registration process.

Teachers, ensemble directors, and other representatives must have authority to submit information on behalf of the people or organizations they represent. A teacher’s or director’s acceptance does not replace any separately required parental consent. Group applicants are responsible for obtaining necessary permissions from performers and, where applicable, their parents or legal guardians.

3 Acceptable Use

You may use the Website only for lawful purposes. You must not submit false or misleading information, impersonate another person, infringe intellectual property or privacy rights, upload malicious software, attempt unauthorized access, disrupt the Website, or use contact information obtained through it for unsolicited bulk messages.

If an account is provided, you are responsible for safeguarding your login credentials and notifying us of suspected unauthorized use.

We may restrict access or reject submissions where reasonably necessary to address fraud, security threats, unlawful conduct, or material violations of these Terms. Program disqualification and any resulting fee consequences remain subject to the applicable program rules and law.

4 Applications and Participation

Submitting an application or making a payment does not guarantee eligibility, acceptance, advancement, an award, or selection for an additional opportunity. MAP will provide the services and benefits expressly included in the applicable program rules.

Applicants must follow the stated submission requirements and deadlines, including the specified time zone. Unless otherwise stated, applicants are responsible for ensuring that submitted links and files remain accessible during the evaluation period. Please contact us promptly if a technical problem affects your submission.

Competition assessment and awards are governed by the applicable competition regulations. Artistic decisions are final to the extent stated in those regulations. This does not prevent reporting a clerical error, suspected misconduct, or a failure to follow the published procedures, and does not restrict rights available under applicable law.

Participation does not guarantee admission to an educational institution, employment, a scholarship, representation, or a future performance engagement. Additional opportunities remain subject to the conditions expressly published for them, including selection, scheduling, and partner availability.

5 Fees Payments and Refunds

The applicable program or payment page will identify fees and currency before payment. Separate rounds or activities may require separate fees. Your bank or payment provider may impose currency conversion or transaction charges outside MAP’s control.

Refunds, withdrawals, transfers, and cancellations are governed by the policy disclosed for the relevant program when you register. Where that policy states that application fees are non-refundable, a voluntary withdrawal, unsuccessful result, or failure to meet entry requirements does not ordinarily entitle you to a refund, except as required by law or expressly provided by that policy.

An expressly published rebate, fee waiver, or participation benefit remains available according to its eligibility and processing conditions. A general non-refund provision does not override an applicable program-specific refund benefit.

Please contact us about duplicate payments, an incorrect charge, or an unprocessed refund benefit, providing enough information to locate the transaction. Do not send full card details by email. Nothing in these Terms limits lawful payment-dispute or consumer rights.

6 Program Changes and Cancellation

We may make reasonable changes to schedules, personnel, formats, or delivery arrangements when necessary. We will communicate material changes to affected registered participants using the contact information provided.

If MAP cancels a paid program without providing the purchased service, we will offer a refund of the amount paid to MAP for the undelivered service. If a material change prevents us from delivering a substantially equivalent service, affected participants may decline the alternative and request a refund for the undelivered portion. Additional rights under applicable law remain unaffected.

Events outside our reasonable control may affect delivery. We will communicate available arrangements, which may include rescheduling, an alternative format, or a refund for undelivered services. Credits will be offered as an option rather than imposed in place of a refund otherwise due. Travel and other third-party expenses are governed by the participant’s arrangements with those providers, subject to applicable law.

7 Submitted Materials and Copyright

You retain any ownership rights you hold in recordings, photographs, biographies, scores, and other materials you submit. You confirm that you have the rights and permissions necessary to submit them and authorize their use as described here and in the applicable program documents.

You grant MAP a non-exclusive, royalty-free permission to receive, store, reproduce as technically necessary, and share submitted materials with authorized personnel, adjudicators, and service providers solely to administer the program, evaluate entries, communicate results, and deliver the agreed services. This permission lasts only as reasonably necessary for those purposes and applicable recordkeeping obligations, subject to privacy rights and the relevant privacy notice.

This administrative permission does not automatically authorize public promotional use. Publication of names, photographs, biographies, or recordings will follow the disclosures and permissions obtained for the program. Where separate media consent is requested, that consent defines the scope of use. For minors, any required parent or guardian authorization must be obtained separately; accepting these Terms alone does not provide blanket publicity consent.

You are responsible for obtaining necessary permissions relating to compositions, arrangements, recordings, accompanying musicians, and other third-party material. MAP does not claim ownership of third-party works contained in an entry.

8 MAP Website Content

Website text, original graphics, logos, and other content owned by MAP are protected by applicable intellectual property laws. Other content belongs to its respective owners.

You may view the Website, share links, and download materials expressly provided for that purpose. Unless permission or applicable law allows otherwise, you may not reproduce, sell, modify, or distribute protected content or use MAP’s name or logo in a way that implies an unauthorized endorsement or affiliation. Certificates must not be altered or used to misrepresent an award or qualification.

9 Privacy

Our separate Privacy Policy explains how we collect, use, retain, and share personal information and how to contact us about privacy requests. Program-specific privacy notices and consent forms may also apply. Acceptance of these Terms does not itself constitute consent to optional marketing or publicity.

Please submit only the information requested for the relevant purpose. Personal identification documents, where required, must be sent through the designated submission process and must not be posted publicly.

10 External Websites and Services

The Website may link to payment providers, video platforms, partner organizations, or other external services. Their own terms and privacy policies apply to their services. We do not control their operation or content. A link, professional affiliation, or reference does not itself establish sponsorship, endorsement, or a formal partnership.

11 Donations

If you make a donation, the amount, frequency, and any stated purpose are those disclosed through the donation process. Program fees are payments for participation and should not automatically be treated as charitable donations. We do not guarantee the tax treatment of any payment in your jurisdiction. Please contact us promptly regarding a mistaken or duplicate donation.

12 Website Availability and Liability

We aim to provide accurate information and reliable access, but the Website may contain errors or experience interruptions. To the extent permitted by law, the Website and its general informational content are provided “as is” and “as available,” without warranties of uninterrupted availability or freedom from technical errors. This does not reduce our obligation to provide services expressly purchased or promised under a program agreement.

To the extent permitted by applicable law, MAP is not liable for indirect or consequential losses arising from Website use. Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, or any liability or remedy that cannot lawfully be excluded or limited.

13 Governing Law and Concerns

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. Any mandatory rights and protections that apply in your place of residence remain unaffected.

Please contact us first if you have a concern so we can seek a practical resolution. Doing so is encouraged but does not waive your legal rights or prevent you from using remedies available under applicable law.

14 Updates and Severability

We may update these Terms and will show the revised effective date on this page. Material changes will be communicated where required, and renewed acceptance will be obtained where necessary. Changes apply prospectively and will not retroactively remove agreed benefits or refund rights for an existing registration without your agreement or a lawful basis.

If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
